Section 40A:12A-6 of the LRHL outlines the process by which a potential redevelopment area is investigated and designated: 1. No area of a municipality shall be determined a redevelopment area unless the governing body of the municipality shall, by resolution, authorize the planning board to undertake a preliminary investigation to determine whether the proposed area is a redevelopment area according to the criteria set forth at N.J.S.A. 40A:12A-5. 2. The governing body of a municipality shall assign the conduct of the investigation and hearing to the planning board of the municipality. 3. The resolution authorizing the planning board to undertake a preliminary investigation shall state whether the redevelopment area determination shall be a âNon-Condemnation Redevelopment Areaâ, which shall authorize all the powers provided in the LRHL except the use of eminent domain, or whether the redevelopment area determination shall authorize the use of eminent domain, a âCondemnation Redevelopment Area.â 4. Before proceeding to a public hearing on the matter, the planning board shall prepare a map showing the boundaries of the proposed redevelopment area and the location of the various parcels of property included therein. There shall be appended to the map a statement setting forth the basis for the investigation. 5. After completing its hearing on the matter, the planning board shall recommend that the delineated area, or any part thereof, be determined, or not be determined, by the municipal governing body to be a redevelopment area. 6. After receiving the recommendation of the planning board, the municipal governing body may adopt a resolution determining that the delineated area, or any part thereof, is a redevelopment area. The East Orange City Council adopted resolution I-244 on July 14, 2025, directing the Planning Board to conduct a non-condemnation area in need of redevelopment investigation of Block 820, Lot 9 (50 E. Park Street) and Block 820, Lot 10 (46 E. Park St.). The Council adopted Resolution I-282 on September 15, 2025, directing the Planning Board to conduct a non-condemnation area in need of redevelopment investigation of Block 174, Lot 24 (102 north Maple Avenue); Block 174, Lot 18.01 (122 North Maple Avenue); Block 462, Lot 34 (543 South Clinton Street); Block 492, Lot 29 (17 Amherst Street); Block 492, Lot 27 (223 Amherst Street); Block 882, Lot 27 (340 Dodd Street); and 171-173 North Park Street (Block 901, Lot 1) â see Appendix A for both resolutions.� East Orange Scattered Sites Area in Need of Redevelopment Preliminary Investigation Report October 23, 2025 -------------------------------------------------------------------------------------------------------------------------------------------------------- 4 Figure 1 provides a location map showing the parcels that comprise the boundaries of the proposed redevelopment area (the âStudy Areaâ.) The balance of this report constitutes the âstatement setting forth the basis for the investigation.â Study Area and Location The Study Area consists of nine tax lots scattered throughout East Orange. Seven of the properties are owned by the City of East Orange, of which four are vacant and three are developed with dilapidated structures that are uninhabitable. The other two privately owned properties are side-by-side on East Park Street. The properties in the Study Area are distributed throughout the city and located in different neighborhoods. Properties 1 and 2 are located in a residential area on the east side of North Maple Avenue just north of the interchange between I-280 and the Parkway. Property 3 is on a residential block the southernmost part of the city, just north of the municipal boundary with the Vailsburg neighborhood of Newark. Properties 4 and 5 are similar lots in a residential area on the west side of Amherst Street just south of the Central Avenue commercial / mixed-use district in the cityâs southwest quadrant. Properties 6, 7, 8, and 9 on East Park Street and Dodd Street are in the cityâs northwest quadrant near the municipal borders with the City of Orange Township and the Borough of Glen Ridge. The generality of buildings are substandard, unsafe, unsanitary, dilapidated, or obsolescent, or possess any of such characteristics, or are so lacking in light, air, or space, as to be conducive to unwholesome living or working conditions. b. The discontinuance of the use of a building or buildings previously used for commercial, retail, shopping malls or plazas, office parks, manufacturing, or industrial purposes; the abandonment of such building or buildings; significant vacancies of such building or buildings for at least two consecutive years; or the same being allowed to fall into so great a state of disrepair as to be untenantable. c. Land that is owned by the municipality, the county, a local housing authority, redevelopment agency or redevelopment entity, or unimproved vacant land that has remained so for a period of ten years prior to adoption of the resolution, and that by reason of its location, remoteness, lack of means of access to developed sections or portions of the municipality, or topography, or nature of the soil, is not likely to be developed through the instrumentality of private capital. d. Areas with buildings or improvements which, by reason of dilapidation, obsolescence, overcrowding, faulty arrangement or design, lack of ventilation, light and sanitary facilities, excessive land coverage, deleterious land use or obsolete layout, or any combination of these or other factors, are detrimental to the safety, health, morals, or welfare of the community. e. A growing lack or total lack of proper utilization of areas caused by the condition of the title, diverse ownership of the real properties therein or other similar conditions which impede land assemblage or discourage the undertaking of improvements, resulting in a stagnant and unproductive condition of land potentially useful and valuable for contributing to and serving the public health, safety and welfare, which condition is presumed to be having a negative social or economic impact or otherwise being detrimental to the safety, health, morals, or welfare of the surrounding area or the community in general. f. Areas, in excess of five contiguous acres, whereon buildings or improvements have been destroyed, consumed by fire, demolished or altered by the action of storm, fire, cyclone, tornado, earthquake or other casualty in such a way that the aggregate assessed value of the area has been materially depreciated. g. In any municipality in which an enterprise zone has been designated pursuant to the "New Jersey Urban Enterprise Zones Act," P.L.1983, c.303 (C.52:27H-60 et seq.) the execution of the actions � East Orange Scattered Sites Area in Need of Redevelopment Preliminary Investigation Report October 23, 2025 -------------------------------------------------------------------------------------------------------------------------------------------------------- 7 prescribed in that act for the adoption by the municipality and approval by the New Jersey Urban Enterprise Zone Authority of the zone development plan for the area of the enterprise zone shall be considered sufficient for the determination that the area is in need of redevelopment pursuant to sections 5 and 6 of P.L.1992, c.79 (C.40A:12A-5 and 40A:12A-6) for the purpose of granting tax exemptions within the enterprise zone district pursuant to the provisions of P.L.1991, c.431 (C.40A:20- 1 et seq.) or the adoption of a tax abatement and exemption ordinance pursuant to the provisions of P.L.1991, c.441 (C.40A:21-1 et seq.). The municipality shall not utilize any other redevelopment powers within the urban enterprise zone unless the municipal governing body and planning board have also taken the actions and fulfilled the requirements prescribed in P.L.1992, c.79 (C.40A:12A-1 et al.) for determining that the area is in need of redevelopment or an area in need of rehabilitation and the municipal governing body has adopted a redevelopment plan ordinance including the area of the enterprise zone. h. The designation of the delineated area is consistent with smart growth planning principles adopted pursuant to law or regulation.â In addition to the eight criteria defined in N.J.S.A. 40A:12A-5, the definition of âRedevelopment areaâ Section 3 of the LRHL includes language that permits the inclusion of parcels that do not meet one of the criteria if they are necessary for the effective redevelopment of the area, stating: âA redevelopment area may include lands, buildings, or improvements which of themselves are not detrimental to the public health, safety or welfare, but the inclusion of which is found necessary, with or without change in their condition, for the effective redevelopment of the area in which they are a part.â Evaluation of the Study Area Properties 1 and 2 â Block 174, Lots 18.01 and 24 â 122 and 102 North Maple Avenue Block 174, Lots 18.01 and 24 are located at 122 and 102 North Maple Avenue, on the east side of the street. The properties are just east of the Garden State Parkway. North Maple Avenue ends at the next block south when it reaches the NJ Transit Train Tracks and Interstate 280 interchange. The properties are in the R-2 Zone, which permits one- and two-family residential uses. The development pattern is consistent through the block of similarly sized lots developed with 2-3 story residential buildings. Both structures were observed to be dilapidated and in poor condition. The buildings are at least partially boarded up and there are broken siding, broken windows, broken masonry steps, damaged roofs and soffits, and other significant evidence of dilapidation and detrimental conditions. The pictures taken during the site visit, which corroborate the cityâs records that the properties are vacant and abandoned, along with the street view images from 2020 showing nearly the same conditions, provide substantial evidence that the properties meet criteria âa.â Property 3 â Block 462, Lot 34 â 543 South Clinton Street Block 462, Lot 34, known as 543 South Clinton Street is a 3,500 square foot lot on the west side of the street in the southern portion of East Orange. The municipal boundary with Newark is within several hundred feet of the property. South Orange Avenue, a mixed-use corridor and major east-west thoroughfare through this portion of Essex County is at the end of the block to the south. The property is in the R-2 Zone, which permits one- and two-family residences. The structure was observed to be in extremely poor condition with boarded up windows and doors, broken front steps, damaged siding and roof, a collapsing detached garage in the rear yard, and a tree trunk blocking access to the driveway. Both lots were observed to be vacant. Both lots have chain link fences along their frontage, but neither is truly secure. The fencing is damaged and overgrown and there is evidence of encroachment onto Lot 27 by the neighboring property, and accumulation of debris and refuse on both properties and along the street frontage. Lot 29 had the remnants of a fire damaged structure on it, which was demolished in 2009, ultimately leading to the propertyâs vacant state that exists today. The city acquired both properties after they fell into tax delinquency and aside from a zoning permit for a new two-family dwelling in 2020, there has not been any movement to improve the properties. City ownership of isolated lots in the R-2 zone is a factor that is discouraging improvement. In addition, the properties are undersized in the R-2 zone, which creates some hardship as to their development. The properties meet � East Orange Scattered Sites Area in Need of Redevelopment Preliminary Investigation Report October 23, 2025 -------------------------------------------------------------------------------------------------------------------------------------------------------- 26 criterion âcâ by virtue of both the public ownership and long-term vacancy along with the undersized nature of the properties creating a condition that inhibits private investment. The lots represent a drain on the cityâs resources because they are not contributing productively to the tax roll while requiring the expenditure of resources on upkeep and maintenance. The properties are an attractive nuisance for littering and dumping, as evidenced by the refuse on and in front of the properties, including an abandoned shopping cart. There is also evidence from site visit observations and aerial images that the neighbor to the north of Lot 27 is occupying a portion of the property for parking / storage. As a result of these factors, both properties can be designated under criterion âeâ. The public ownership of these vacant, isolated, residential lots is a factor that prevents them from being improved. The condition of the properties is stagnant, unproductive, has a negative economic impact by draining the cityâs resources without contributing to the tax base, and has a negative social impact by accumulating litter and overgrowth in a residential neighborhood. Properties 6 and 7 â Block 820, Lots 10 and 9 â 46 East Park Street and 50 East Park Street Block 820, Lot 10, known as 46 East Park Street and Block 820, Lot 9, known as 50 East Park Street are residential lots on the north side of East Park Street in the R-2 Zone. Lot 10 is an approximately 0.9 acre lot with 100 feet of frontage on East Park Street, developed with a single-family residence that has substantial undeveloped yard area to the rear. Lot 9 is a 100â x 256â, 25,600 square foot property developed with a single￾family residence. The lots to the west and south across East Park Street are developed with garden apartment complexes, while the lots to the east have a similar large lot residential development pattern, and the lots to the north are narrower residential lots typical of the R-2 zone. The municipal boundary with the City of Orange Township is nearby to the west. � Figure 13 - Aerial Location Map Block 820, Lots 10 and 9 Figure 14 - Google Earth aerial image, 46 and 50 East Park Street Property Background 46 East Park Street (Lot 10) was acquired by its present owner in 2022 after having been in foreclosure in 2019 and having a history of tax liens prior to that. The conditions of the property are not appreciable different today than in various available street view images from the past decade. 50 East Park Street (Lot 9) has been owned by the current owner for several decades. � East Orange Scattered Sites Area in Need of Redevelopment Preliminary Investigation Report October 23, 2025 -------------------------------------------------------------------------------------------------------------------------------------------------------- 28 Both lots were previously reviewed by the Planning Board as part of a redevelopment investigation in April 2025. At that time, the Board did not recommend the designation of the properties as an area in need of redevelopment. Additional city records referenced in this report indicate several maintenance related issues that are signs of dilapidation of the property and structure, that will continue to create unwholesome and unsafe conditions and lead to further blight of the property if unabated. On August 14, 2025, the owner / occupant of 50 Park Place, Ms. Doreen Fields, sent a letter to Alycia Cohen, the Director of Policy, Planning & Development for the City of East Orange. The letter explained that Ms. Fields is not able to afford the repairs and upkeep associated with her property. Site Visit A site visit was conducted on October 17, 2025 to review the exterior conditions of the structures on East Park Street and the surrounding neighborhood context. Both dwellings showed signs of physical deterioration. Roof, soffit, and siding damage were observed on Lot 10. The detached garage behind the residence on Lot 10 is collapsing. The fencing between the properties is damaged and falling. Several cars, which did not appear to have moved in many months based on the dirt on the windshields and overgrowth surrounding them were observed on Lot 9. Deferred maintenance issues for both properties were evident. There is a pattern of violations for 46 East Park Street that reflects serious property maintenance issues, and the exterior of both the principal structure and accessory garage show signs of dilapidation and disrepair. While not as severe or extensive as 50 East Park Street, there is also a pattern of property maintenance issues associated with that property, including a damaged fence that has not been repaired. The letter from the property owner (Appendix D) reflects an inability to properly maintain the site, which already has documented conditions that are detrimental to the health, safety, and welfare of occupants and the general public. Based on these factors and the corroborating photographic evidence, the properties can be designated under criterion âa.â Property 8 â Block 882, Lot 27 â 340 Dodd Street Block 882, Lot 27, known as 340 Dodd Street, is a 33â x 114â, approximately 3,762 square foot vacant lot on the north side of Dodd Street in the northern portion of East Orange. The property is in the R-2 Zone, which permits one- and two-family residences. Most of the development on the block follows a similar residential pattern, although there are some commercial uses interspersed along Dodd Street. Google Streetview shows that the condition of the property today is generally the same as it was in 2020, shortly after the city acquired it. The municipal boundary with the City of Orange Township is less than two blocks to the west along Dodd Street. The property is in the R-2 Zone, which permits one- and two-family residences. The area has a mix of residential and commercial developments, with no strong prevailing character. The lot immediately to the west is also vacant and fenced. Property Background 171-173 North Park Street was acquired by the city in 2017 through foreclosure following a history of tax liens. The oldest Streetview images date to 2007 and show the conditions largely as they are today, nearly twenty years later. According to the cityâs SDL Portal, a demolition permit was issued for the property in 1997, with no subsequent development activity, so it has been vacant for over twenty-eight years. Block 810, Lot 36 (112 Washington Street), Block 820, Lot 10 (46 East Park Street); and, Block 820, Lot 9 (50 East Park Street), along with all strect and rights of way appurtenant thereto (the âInitial Study Areaâ) and to recommend to the City whether the Study Area should be designated as a non-condemnation redevelopment arca in accordance with the Redevelopment Law; and WHEREAS, the Board caused Alexander McClean, AICP, PP, the Cityâs Principal Planner (the âCity Plannerâ) to conduct a preliminary investigation of the Initial Study Area in accordance with the Redevelopment Law; and WHEREAS, the City Planner prepared a map of the Study Area and an investigation report entitled âArca in Need of Redevelopment Investigation: 40 Madonna Place, 112 Washington Sireet, and 46 & 50 East Park Streetâ dated March 13, 2025 (the Studyâ); and WHEREAS, the Redevelopment Law requires the Planning Board to conduct a public hearing prior to making its determination whether the Study Area should be designated as an area in need of redevelopment, at which hearing the Planning Board shall hear all persons who are interested in or would be affected by a determination that the Study Area is an area in need of redevelopment; and WHEREAS, the Redevelopment Law further requires the Planning Board, prior to conducting such public hearing, to publish notice of the hearing in a newspaper of general circulation in the municipality once each week for two (2) consecutive weeks, with the last publication made not less than ten (10) days prior to such public hearing; and WHEREAS, the Redevelopment Law further requires such nofice to be mailed at least ten (10) days prior to such hearing to the last owner of the Study Area according to the Cityâs assessment records; and WHEREAS, the Planning Board caused the aforementioned notices to be published on March 13,2025, and March 20, 2025, in the Courier News, and served on the last owner(s) of the Study Area according to the Cityâs assessment records on March 21, 2025; and WHEREAS, on April 2, 2025, pursuant 10 the Redevelopment Law, the Planning Board held a duly noticed public hearing concerning the Study, giving all persons who were interested in or would be affected by a determination that the Study Area is an area in need of redevelopment the opportunity to be heard; and WHEREAS, at said public hearing, the Planning Board considered the Study, heard the comments of the City Planner, opened the meeting for public comments. and deliberated on the matter using the criteria set forth in the Redevelopment Law; and WHEREAS, the City Planner concluded in the Study and testified to the Planning Board that the Study Area, along with all streets and rights of way appurtenant thereto, meets the criteria set forth in the Redevelopment Law and should be designated as a non-condemnation redevelopment area; and WHEREAS, on April 16, 2025, the Planning Board adopted two resolutions memorializing its findings, recommending that Block 430.01, Lot 10.02 (40 Madonna Place) and Block 810, Lot 36 (112 Washington Street) (the âProposed Redevelopment Areasâ) be designated as a non-condemnation redevelopment area and accepting and adopting the conclusions contained in the Study with regard to the Proposed Redevelopment Ares; and WHEREAS, the Planning Board found that Block 820, Lots 9 and 10 (46 and 50 East Park Street) does not satisfy the criteria to be designated as a non-condemnation redevelopment area and rejected the conclusions contained in the Study with regard to Block 820, Lots 9 and 10; and WHEREAS, the City Council agreed with the recommendation of the Board and found that such canclusion is supported by substantial evidence as set forth in the Study; and WHEREAS, on June 16, 2025, the City Council adopted Resolution 1-222 designating the Proposed Redevelopment Areas as a non-condemnation area, pursuant to N.LS.A. 40A:12A-6; and WHEREAS, based on new information received by the City from the owners of 46 and 50 East Park Street, the City Council now seeks to re-authorize and direct the Planning Board to investigate Block 820, Lot 10 (46 Fast Park Street) and Block 820, Lot 9 (50 East Park Street) again, along with all street and rights of way appurtenant thereto and to recommend to the City whether the Study Area should be designated as a non-condemnation redevelopment area in accordance with the Redevelopment Law. CITY COUNCIL OF EAST ORANGE PF Resolution offered by Council Member JAMES RESOLUTION AUTHORIZING AND DIRECTING THE CITY PLANNING BOARD TO CONDUCT AN AREA IN NEED OF REDEVELOPMENT INVESTIGATION OF CERTAIN PROPERTIES IDENTIFIED IN THE CITY'S TAX RECORDS AS BLOCK 174, LOT 24 (102 NORTH MAPLE AVENUE); BLOCK 174, LOT 18.01 (122 NORTH MAPLE AVENUE), BLOCK 462, LOT 34 (543 SOUTH CLINTON STREET); BLOCK 492, LOT 29 (217 AMHERST STREET); BLOCK 492, LOT 27 (223 AMHERST STREET); BLOCK 882, LOT 27 (340 DODD STREET); AND 171-173 NORTH PARK STREET (BLOCK 901, LOT 1) TO DETERMINE âWHETHER THE PROPERTIES SATISFY THE LOCAL REDEVELOPMENT AND HOUSING LAW CRITERIA TO BE DECLARED AS NON-CONDEMNATION AREAS IN NEED OF REDEVELOPMENT WHEREAS, the Local Redevelopment and Housing Law, NSA. 40A:12A-1 et seq. (as âWHEREAS, to make such a determination under the LRHL, the goveming body (the âCity Council") of the City of East Orange (the âCityâ) must first authorize the City Planning Board (the âPlanning Board") to conduct a preliminary investigation of the area and make recommendations to the WHEREAS, the City Council believes it is in the best interests of the City that an investigation be conducted with respect to the following parcels as identified on the tax maps of the City along with all streets and rights of way appurtenant thereto (collectively, the âStudy Areaâ to determine whether all or a portion of the Study Area meets the criteria set forth in the LRHL to be designated as areas in need of redevelopment; and NP rr LRHL, specifically N.J.S.A. 40A 12A-5, and should be designated as areas in need of redevelopment, (hereinafter referred to as âNon-Condemnation Redevelopment Areaâ); and "WHEREAS, the City Council therefore authorizes and directs the Planning Board to conduct a preliminary investigation of the Study Area and to make recommendations to the City Council, all in accordance with the LRHL; and NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of East Orange, New Jersey as follows: 2. The Planning Board is hereby authorized and directed to conduct an investigation, pursuant should be designated a âNon-Condemnation Redevelopment Areaâ 3. As part of its investigation, the Planning Board shall prepare a map showing the boundaries of the Study Area and the location of the parce contained therein, and appended thereto shall be a statement setting forth the basis of the investigation. 4. The Planning Board shall conduct a public hearing in accordance with the LRHL, after giving due notice of the proposed boundaries of the Study Area and the date of the hearing to any persons who ae terested 1 of would be acted by # dfeminaion tha the Study Aron So rem men oe redeem 5. At the public hearing, the Planning Board shall hear from the all persons who are interested in or would be affected by a determination that the Study Area is in an area in need of redevelopment and evidence in support of any objections shall be received and considered by the Planning Board and shall be made part of the public record. 6. After conducting its investigation, preparing the Study Area and conducting a public hearing at which all objections to the proposed designation are received and considered, the Planning Board shall make a recommendation to the City Council as to whether the City Council should designate all or a portion of the Study Area as a Non-Condemnation Redevelopment â 7. In the event the Planning Board recommends that all or a portion of the Study Area be designated as a Non-Condemnation Redevelopment Area, the Planning Board shall commence with the preparation of the redevelopment plan and transmit the proposed redevelopment plan to the City Council for its adoption. 8.1 any port of his Resolution shall be deemed invalid, such parts hal be severed and the invalidity thereby shall not affect the remaining parts of this Resolution. 9. One of those preliminary investigation reports examined 30 South Arlington Avenue and the other report examined 40 Madonna Place, 112 Washington Street, and 46 and 50 East Park Street. At the end of my presentation of the two studies, the Board voted to recommend, based on the information provided at the time, all the properties except 46 and 50 East Park Street for designation as areas in need of redevelopment. Following the meeting on April 16th, the City Council adopted a resolution on June 16th accepting the recommendation of the Planning Board and directing the Board to prepare redevelopment regulations for 30 South Arlington Avenue, 40 Madonna Place, and 112 Washington Street. Pursuant to that resolution (Resolution I-222), the Scattered Site Redevelopment Plan was amended to include those three (3) designated sites, which was presented to the Planning Board on August 6 th. The amended Scattered Site Redevelopment Plan is currently pending a second reading by the City Council with Ordinance No. 27 of 2025. The primary reason for this correspondence, however, is not on the status of the three Council￾designated sites, but on new information that has been presented to the Division of Comprehensive Planning regarding 50 East Park Street (Block 820, Lot 9). During my presentation to the Planning Board on April 16th, I noted that, similar to 46 East Park Street, there were several complaints and violations filed by the Department of Code Enforcements that included the following: Code Enforcement Complaints: ⢠CPT-17-02614 (dated 7/20/17): A large decaying tree is on the property and is currently dying. Leaving fallen branches as well as causing health and safety concerns.� Page 2 of 3 ⢠CPT-221703964297 (dated 1/13/22): Leaves and garbage around exterior premises. ⢠CPT-24-1158281710 (dated 1/10/24): Various exterior violations. Code Enforcement Violations: ⢠CVIO-24-01171 (dated 1/24/24): Exterior around entire premises, in violation of §159- 62 - Maintenance of exterior of premises. ⢠CVIO-24-01172 (dated 1/24/24): Exterior around entire premises, in violation of §159- 64 - Residential: appearance of exterior of premises and structures. ⢠CVIO-24-01173 (dated 1/24/24): Exterior right side, in violation of §159-62 - Maintenance of exterior of premises. ⢠CVIO-24-01174 (dated 1/24/24): Exterior around building, in violation of §159-66 Residential areas: exterior structural soundness and general maintenance. ⢠CVIO-24-01175 (dated 1/24/24): Exterior right side, in violation of §159-64 Residential: appearance of exterior of premises and structures. The complaints and violations above are largely related to the property ownerâs inability to make the necessary repairs that are likely substantial given the age of the home, which was constructed in 1875. The property ownerâs inability to maintain their property has recently been confirmed by a letter (attached herein) from the property owner, dated August 14, 2025, and received by the Director of the Department of Policy, Planning, and Development indicating the property ownerâs desire to relinquish sole ownership of the property as part of a redevelopment venture that includes 46 East Park Street. This correspondence has been prepared in advance of another preliminary investigation of 46 and 50 East Park Street, which my office seeks to present at a Planning Board meeting in November.
