The Millburn Township website is available at https://www.twp.millburn.nj.us/.� MILLBURN TOWNSHIP CHARTER STUDY COMMISSION RESOLUTION 25-004 AUTHORIZING THE AWARD OF CONTRACT FOR LEGAL SERVICES – CHARTER STUDY COMMISSION ATTORNEY [KING, MOENCH & COLLINS LLP] WHEREAS, legal services are required for the Millburn Charter Study Commission to fulfill its statutory obligations under the Optional Municipal Charter Law, N.J.S.A. 40:69A￾1 et seq., including guidance on statutory compliance, procedural requirements, analysis of municipal government forms, public meeting compliance, public records compliance, and preparation of required reports and recommendations; and WHEREAS, King, Moench & Collins LLP is qualified in training and experience to perform such services, with specific expertise in serving as counsel to Charter Study Commissions; and WHEREAS, King, Moench & Collins LLP has provided the Business Entity Disclosure Certification in accordance with N.J.S.A. 19:44A-20.8 and completed Political Contribution Disclosure Form; and WHEREAS, the Local Public Contracts Law (N.J.S.A. 40A:11-1 et seq.) requires that resolution authorizing the payment of such professional fees without competitive bidding must be publicly advertised. NOW, THEREFORE, BE IT RESOLVED by the Millburn Township Charter Study Commission as follows: 1. That the Chair and Secretary of the Commission are hereby authorized and directed to execute an agreement, in a form subject to the approval of the Township Attorney, with Michael L. Collins, Esq. of King, Moench & Collins LLP, 200 Schulz Drive, Suite 402, Red Bank, NJ 07701 to be retained as Counsel to the Millburn Charter Study Commission for the duration of the Commission’s study. 2. That legal services will be provided at a blended hourly rate of $225.00 per hour, not to exceed $45,000.00 without prior Commission approval. 3. That the Commission will be notified by counsel when 80% of the $45,000.00 authorization is reached. 4. That this contract is made without competitive bidding as a “professional service” under the provisions of the Local Public Contracts Law because of the qualitative nature of the service to be performed. 5.
